Fisiocrem New Zealand Practitioner Free-Trial Agreement

This Practitioner Free-Trial Agreement (referred to as "Agreement") sets forth the terms and conditions governing your participation in the Fisiocrem New Zealand Practitioner Free-Trial (referred to as "Free Trial") and constitutes a legally binding contract between Fisiocrem NZ Ltd and you.

By participating in the Free Trial, you acknowledge that:

Eligibility:
1.1. You must be a New Zealand healthcare professional practicing within New Zealand.
1.2. You have not previously participated in the Fisiocrem Free Trial in New Zealand or Australia. Participation in the Australian trial renders you ineligible for the New Zealand trial.

Submission of Free-Trial Form:
2.1. Submission of the Free-Trial form constitutes acceptance of these terms and conditions.
2.2. By submitting the Free-Trial form, you confirm that you are at least 18 years of age and have the legal authority to enter into this Agreement.

Acceptance or Rejection:
3.1. We reserve the right to accept or reject any Free-Trial request for any reason, including but not limited to product availability or errors in product description.
3.2. If your Free-Trial request is rejected, we will endeavor to notify you within a reasonable time frame.

Delivery:
4.1. Free-Trial products will only be delivered to addresses within New Zealand.
4.2. It is your responsibility to ensure the accuracy of the delivery address provided. We will not resend Free-Trial products for incorrectly entered addresses.

Consent to Communication:
5.1. By submitting the Free-Trial form, you consent to being contacted by us or our authorized service providers regarding the Free Trial and Fisiocrem products.

Disclaimer of Warranties; Limitation of Liability:
6.1. While we strive to provide a satisfactory experience, we cannot guarantee uninterrupted availability, security, or error-free use of the Free Trial of our topical cream.
6.2. We are not liable for any adverse reactions or damages resulting from your use of the Free Trial of our topical cream, except as expressly stated by us.

Indemnification:
7.1. You agree to indemnify and hold Fisiocrem NZ Ltd harmless from any claims arising out of your breach of these terms or violation of any law.

Severability:
8.1. If any provision of this Agreement is found to be unlawful or unenforceable, the remaining provisions shall remain in full force and effect.

Force Majeure:
9.1. Fisiocrem NZ Ltd shall not be liable for any failure or delay in fulfilling its obligations under this Agreement due to events beyond its control.

Governing Law:
10.1. This Agreement shall be governed by and construed in accordance with the laws of New Zealand.

Changes to this Agreement:
11.1. Fisiocrem NZ Ltd reserves the right to amend this Agreement at any time. Amendments will be effective as of the first day of the calendar month following their posting.
